ABA Business Law Dispute Resolution Committee Offerings at Annual Meeting

At the ABA Annual Meeting this week I will be privileged and honored to be entrusted with the Chair of the Dispute Resolution Committee of the Business Law Section for a three-year term.  The Committee is growing in size and influence, and will be associated with several CLE offerings.

The Committee will present a program on “Online Dispute Resolution: The Past and the Future” at 10:30 Saturday August 4 at the Marriott Downtown.  Panelists include Karol Denniston, Lawrence Graves and Colin Rule.  It will review the work of the ODR Task Force of 2000, and preview the work now contemplated by the new UNCITRAL and other initiatives.  The panel will also discuss the current state of the art and technology of “virtual” mediation and arbitration.  The presentation is co-sponsored by the Business and Corporate Litigation Committee, the Consumer Financial Services Committee, the Cyberspace Committee, the International Business Law Committee and the Dispute Resolution Section.

The Committee is also co-sponsoring several presentations in Chicago:

“What’s Happening Out There? Arbitration Jurisprudence in the Wake of Recent Supreme Court Precedent” will be offered at 10:30 a.m. Friday August 3 at the Marriott Downtown.  Panelists include Deepak Gupta, Judge William Highberger, Archis Parasharami, Peter Phillips, Edna Sussman and Erich Tuchmann.  The presentation is sponsored by the Business and Corporate Litigation Committee and co-sponsored by the Dispute Resolution Committee, Federal Regulation of Securities, State Regulation of Securities, and the Judge’s Initiative.

“Corporate Litigation Problems That Keep General Counsel Awake At Night and How to Solve Them” is presented by the Corporate Counsel Committee and co-sponsored by a number of Committees, including Dispute Resolution.  It will be offered at 2:30 p.m. Friday at the Marriott Downtown.

We also note that our colleagues at the Dispute Resolution Section are offering a program at 3:45 p.m. Thursday August 2, on Recent Developments in Interpretation of Federal and State Arbitration Statutes.  Panelists include Hiro N. Aragaki, Terry Moritz and Eric Tuchmann.  It will be at the main CLE Centre at the Hyatt Regency.  The Dispute Resolution Section will also present “Myth Busting: Arbitration Perceptions, Realities and Ramifications” at 2:00 p.m. the same day at the  Hyatt, which the Committee is co-sponsoring. The program will review current perceptions of arbitration through a discussion of the many surveys that have been conducted in recent years as to how users view arbitration and through a user’s perspective. Panelists include Mark C. Morril, Richard W. Naimark, Nikolaus Pitkowitz, Edna Sussman, Roy Weinstein and Stu Widman.

The Committee itself will meet at 1:00 pm on Saturday August 4 on the fifth floor of the Marriott Downtown in Chicago.  We look forward to visitors and, we hope, new members.
