interpretation of it?\u00a0 To refute?\u00a0 To underscore partial agreement?\u00a0 To argue?\u00a0 To bring out what the witness <em>failed<\/em> to say or do?<\/p>\n<p>Contributors <a href=\"http:\/\/www.whitecase.com\/clamm\/\" target=\"_self\">Carolyn Lamm<\/a>, <a href=\"http:\/\/www.whitecase.com\/fvasquez\/\" target=\"_self\">Francis Vasquez<\/a> and <a href=\"http:\/\/www.whitecase.com\/mdrossos\/\" target=\"_self\">Matthew Drossos<\/a> cite the first of their &#8220;Ten Guidelines for the Cross-Examination of Financial and Technical Experts&#8221; as &#8220;Know Your Purpose.&#8221;\u00a0 It is not as easy as it may first appear, and becomes more complicated when layered with some of their other Guidelines, such as &#8220;Adapt To Your Audience,&#8221; &#8220;Focus On What The Expert Did Not Do,&#8221; and &#8220;Do Not Engage In Debates.&#8221;<\/p>\n<p>The tone of these essays is as enjoyable as the content is enlightening.\u00a0 <a href=\"http:\/\/www.hugheshubbard.com\/John-M-Townsend\/\" target=\"_self\">John Townsend<\/a>discusses the charmingly named practice of &#8220;hot-tubbing&#8221; expert witnesses &#8212; allowing experts to give their testimony concurrently and in each others&#8217; presence so that any proffer may be immediately tested.\u00a0 (Notes Townsend, &#8220;There is not much to be done with the paid liar other than to attack.&#8221;)\u00a0 <a href=\"http:\/\/www.brickcourt.co.uk\/silks\/hilary-heilbron-qc.asp\" target=\"_self\">Hilary Heilbron<\/a> and <a href=\"http:\/\/www.brickcourt.co.uk\/juniors\/klaus-reichert-sc.asp\" target=\"_self\">Klaus Reichert<\/a>\u00a0study the art of when to cross-examine, and when to stop cross-examination, by citing the authority of Kenny Rogers: <a href=\"http:\/\/www.youtube.com\/watch?v=kNnrTNFWcsg\" target=\"_self\">&#8220;You got to know when to\u00a0hold &#8217;em, know when to fold &#8217;em.&#8221;<\/a><\/p>\n<p><a href=\"http:\/\/www.arthurwrovine.com\/\" target=\"_self\">Arthur Rovine<\/a>, in his chapter on &#8220;Polite Cross-Examination,&#8221; fits in the story of the following colloquy:<\/p>\n<blockquote><p><em>Q: You&#8217;re not a partner in the firm, are you?<\/em><\/p>\n<p><em>A: No I am not.<\/em><\/p>\n<p><em>Q:\u00a0 Why not?\u00a0 Why are you not a partner in the firm?<\/em><\/p><\/blockquote>\n<p>The roster of contributors reads like a list of the greats in the field.\u00a0 The mighty <a href=\"http:\/\/www.gibsondunn.com\/lawyers\/lshore\" target=\"_self\">Laurence Shore<\/a> writes on &#8220;Cross-Examination Without Discovery.&#8221;\u00a0 <a href=\"http:\/\/www.bdplaw.com\/titanweb\/bdp\/BDPwebsite.nsf\/AllDoc\/A56CE8BF75BBA45C87256DC7006D234E?OpenDocument\" target=\"_self\">David Haigh<\/a> instructs us on &#8220;When to Be Friendly and When to Impeach.&#8221;\u00a0 <a href=\"http:\/\/www.stblaw.com\/bios\/RSmit.htm\" target=\"_self\">Robert Smit<\/a> takes the bull by the horns and addresses &#8220;Cross-Examining Before Civil Law Arbitrators.&#8221;\u00a0 And the richly experienced <a href=\"http:\/\/www.deweyleboeuf.com\/en\/People\/C\/JamesHCarter\" target=\"_self\">James Carter <\/a>writes the final word on a notoriously risky decision: &#8220;The Perils of Cross-Examination in a Language Other Than the Language of the Proceeding.&#8221;<\/p>\n<p>The book is eye-opening, entertaining and richly provocative.\u00a0 It would be difficult to imagine a more authoritative single volume on the subject, and it is of inestimable value to counsel and tribunal alike.<\/p>\n<p style=\"text-align: center;\"><a href=\"http:\/\/supremejustice.files.wordpress.com\/2008\/09\/crossxam1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-16\" title=\"crossxam1\" src=\"http:\/\/supremejustice.files.wordpress.com\/2008\/09\/crossxam1.jpg?w=463&amp;h=308\" alt=\"\" width=\"463\" height=\"308\" \/><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A new volume offers definitive advice on how to cross-examine witnesses in international arbitration &#8212;
