{"id":1891,"date":"2017-03-14T21:18:33","date_gmt":"2017-03-15T01:18:33","guid":{"rendered":"http:\/\/www.businessconflictmanagement.com\/blog\/?p=1891"},"modified":"2017-04-28T11:23:31","modified_gmt":"2017-04-28T15:23:31","slug":"apples-terms-and-conditions","status":"publish","type":"post","link":"http:\/\/www.businessconflictmanagement.com\/blog\/2017\/03\/apples-terms-and-conditions\/","title":{"rendered":"Apple&#8217;s Terms and Conditions"},"content":{"rendered":"<p>The invaluable publisher <a href=\"https:\/\/www.drawnandquarterly.com\/\">Drawn and Quarterly<\/a> has ventured smack dab into current legal controversy with the February 2017 release of <a href=\"https:\/\/www.drawnandquarterly.com\/terms-and-conditions?qt-shop_navigation=1&amp;shop_item=1\">Terms and Conditions: The Graphic Novel<\/a>, by <a href=\"https:\/\/en.wikipedia.org\/wiki\/Robert_Sikoryak\">Robert Sikoryak<\/a>.<\/p>\n<p>The artist has taken the complete text of the iTunes Terms and Conditions and set them to graphic comics form. \u00a0Moreover, each page of the book is an homage to a particular classic comic. \u00a0So the legalese of the click-through user agreement promulgated by Apple is adorned by exciting, often iconic, comics such as Peanuts, Donald Duck, Green Lantern, Rex Morgan and Barney Google. \u00a0Each page has been modified so that the leading male character is a mock-up of Steve Jobs, complete with black turtleneck and a scruffy beard.<\/p>\n<p style=\"text-align: center\"><img decoding=\"async\" src=\"https:\/\/s3-eu-central-1.amazonaws.com\/centaur-wp\/creativereview\/prod\/content\/uploads\/2017\/02\/TERMSinterior_97-CRsite.jpg\" \/><\/p>\n<p>Needless to say, as a student of consumer arbitration jurisprudence I immediately sought the portions of the book addressing dispute resolution. \u00a0I expected to \u00a0find both an arbitration agreement and a class action waiver. \u00a0I found neither.<\/p>\n<p style=\"text-align: center\"><img decoding=\"async\" src=\"https:\/\/creators-images.vice.com\/content-images\/contentimage\/no-slug\/e70fe94def027caedfefc40481cb7693.jpg\" \/><\/p>\n<p>The agreement provisions from the <a href=\"http:\/\/www.businessconflictmanagement.com\/blog\/wp-content\/uploads\/2017\/03\/iTunes-Store.pdf\">iTunes Store<\/a>\u00a0are based on Beetle Bailey, and call for application of California law and resolution in the courts of California. \u00a0So does the <a href=\"http:\/\/www.businessconflictmanagement.com\/blog\/wp-content\/uploads\/2017\/03\/App-STore.pdf\">App Store<\/a>\u00a0agreement (based on the Japanese manga artist\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Katsuhiro_Otomo\">Katsuhiro Otomo<\/a>), and so does the provision from the <a href=\"http:\/\/www.businessconflictmanagement.com\/blog\/wp-content\/uploads\/2017\/03\/Apple-Music.pdf\">Apple Music<\/a>\u00a0contract (based on Brenda Starr). \u00a0No arbitration, no class action restrictions.<\/p>\n<p>One feature will never die, though &#8212; the one that says that Apple can change any of these terms unilaterally, and that continued use of the product will constitute the consumer&#8217;s agreement to that <a href=\"http:\/\/www.businessconflictmanagement.com\/blog\/wp-content\/uploads\/2017\/03\/CHanges.pdf\">change<\/a>.<\/p>\n<p>I get nostalgic for classic comics, and even more nostalgic for contracts where both parties are aware of what they&#8217;re agreeing to.<\/p>\n<p style=\"text-align: center\"><img loading=\"lazy\" decoding=\"async\" class=\"\" src=\"https:\/\/img.clipartfest.com\/6bff188fd15d262ccb7ca4dcd58cc3d8_agreement20clipart-clipart-agreement_1300-1150.jpeg\" width=\"482\" height=\"426\" \/><\/p>\n<p style=\"text-align: center\">\n","protected":false},"excerpt":{"rendered":"<p>The invaluable publisher Drawn and Quarterly has ventured smack dab into current legal controversy with the February 2017 release of Terms and Conditions: The Graphic Novel, by Robert Sikoryak.
