{"id":1640,"date":"2015-08-11T09:27:23","date_gmt":"2015-08-11T13:27:23","guid":{"rendered":"http:\/\/businessconflictmanagement.com\/blog\/?p=1640"},"modified":"2015-08-11T09:27:23","modified_gmt":"2015-08-11T13:27:23","slug":"adr-related-legislation","status":"publish","type":"post","link":"http:\/\/www.businessconflictmanagement.com\/blog\/2015\/08\/adr-related-legislation\/","title":{"rendered":"ADR-Related Legislation"},"content":{"rendered":"<p>Larson Frisby, of the ABA Governmental Affairs Office, recently offered an update on the status of federal ADR legislation and other related measures. \u00a0Some of the most interesting proposals are briefly described below.<\/p>\n<p style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" class=\"\" src=\"https:\/\/upload.wikimedia.org\/wikipedia\/commons\/f\/fb\/Obama_Health_Care_Speech_to_Joint_Session_of_Congress.jpg\" alt=\"\" width=\"672\" height=\"448\" \/><\/p>\n<p style=\"text-align: center;\">\n<p><!--more--><\/p>\n<p>The Dodd-Frank Act required the Consumer Financial Protection Bureau to conduct a study on pre-dispute arbitration agreements. \u00a0That <a href=\"http:\/\/www.consumerfinance.gov\/reports\/arbitration-study-report-to-congress-2015\/\">study issued on March 10, 2015<\/a>. \u00a0It was highly critical of both consumer mandatory arbitration and consumer class action waivers. \u00a0It seems likely that the CFPB will issue regulations limiting or even prohibiting such clauses to resolve consumer financial disputes. \u00a0(Of course, whether making the courts the sole avenue of redress for consumers is an improvement is another question.)<\/p>\n<p>The <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/senate-bill\/1133\">Arbitration Fairness Act<\/a> continues its (by now) perennial appearance and seems destined to another perennial defeat. \u00a0The Act would ban all mandatory pre-dispute arbitration &#8220;agreements&#8221; for employment, consumer, antitrust and civil rights disputes. \u00a0The current version does not ban pre-dispute arbitration clauses in franchise agreements. \u00a0The bill is in committee and not expected to be acted upon.<\/p>\n<p>Mandatory arbitration of securities disputes are sought to be banned by a <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/house-bill\/1098?q=%7B%22search%22%3A%5B%22%5C%22hr1098%5C%22%22%5D%7D&amp;resultIndex=1\">third bill<\/a>, which &#8212; lacking any Republican support &#8212; is unlikely to advance.<\/p>\n<p>The same fate is shared by a bill seeking to prohibit employers from requiring their employees to <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/senate-bill\/852?q=%7B%22search%22%3A%5B%22%5C%22s852%5C%22%22%5D%7D&amp;resultIndex=1\">arbitrate rape claims<\/a>. \u00a0Notably, this bill excludes from its coverage employees who are elected to public office, as well as their personal staff and immediate advisors.<\/p>\n<p>The <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/house-bill\/2079?q=%7B%22search%22%3A%5B%22%5C%22hr2079%5C%22%22%5D%7D&amp;resultIndex=1\">Court Legal Access and Student Support (CLASS) Act<\/a> would invalidate all mandatory pre-dispute agreements to arbitrate enrollment disputes between a student and a college. \u00a0It too has been referred to committee and no further action has been taken.<\/p>\n<p>A proposal to restructure the Surface Transportation Board, by contrast, is likely to be enacted. \u00a0And it proposes the establishment of a <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/senate-bill\/808?q=%7B%22search%22%3A%5B%22%5C%22s808%5C%22%22%5D%7D&amp;resultIndex=1\">voluntary and binding arbitration process to resolve rail rate and practice disputes,<\/a> once those claims have been filed with the Board.<\/p>\n<p>Legislation seeking to improve the process involved in FOIA requests contains a provision that would require the Office of Government Information Services to <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/senate-bill\/337?q=%7B%22search%22%3A%5B%22%5C%22s337%5C%22%22%5D%7D&amp;resultIndex=1\">offer mediation services to resolve disputes between FOIA requesters and administrative agencies<\/a>. \u00a0The bill enjoys strong bipartisan support in both houses and is likely to pass.<\/p>\n<p>Several measures address the establishment or reform of ombuds positions in certain federal agencies. \u00a0They include ombuds functions involving <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/senate-bill\/192?q=%7B%22search%22%3A%5B%22%5C%22s192%5C%22%22%5D%7D&amp;resultIndex=1\">long-term care disputes<\/a>, <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/house-bill\/2325?q=%7B%22search%22%3A%5B%22%5C%22hr2325%5C%22%22%5D%7D&amp;resultIndex=1\">Medicare and Medicaid<\/a>, <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/house-bill\/1735?q=%7B%22search%22%3A%5B%22%5C%22hr1735%5C%22%22%5D%7D&amp;resultIndex=1\">small business procurement<\/a>, the <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/house-bill\/81?q=%7B%22search%22%3A%5B%22%5C%22hr81%5C%22%22%5D%7D&amp;resultIndex=1\">Federal Air Marshall Service<\/a>, and the <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/house-bill\/80?q=%7B%22search%22%3A%5B%22%5C%22hr80%5C%22%22%5D%7D&amp;resultIndex=1\">Transportation Security Administration<\/a>.<\/p>\n<p>Anybody out there taking note of this but not a member of the ABA? \u00a0<a href=\"http:\/\/www.americanbar.org\/aba.html\">Get with the program<\/a>, please.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A review of pending federal legislation relating to ADR<\/p>\n","protected":false},"author":3,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[11,34],"tags":[8,33],"class_list":["post-1640","post","type-post","status-publish","format-standard","hentry","category-conflict-resolution","category-united-states","tag-adr","tag-public-policy"],"aioseo_notices":[],"_links":{"self":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/posts\/1640","targetHints":{"allow":["GET"]}}],"collection":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/users\/3"}],"replies":[{"embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/comments?post=1640"}],"version-history":[{"count":0,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/posts\/1640\/revisions"}],"wp:attachment":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/media?parent=1640"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/categories?post=1640"},{"taxonomy":"post_tag","embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/tags?post=1640"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
