{"id":1196,"date":"2013-02-16T13:23:08","date_gmt":"2013-02-16T17:23:08","guid":{"rendered":"http:\/\/businessconflictmanagement.com\/blog\/?p=1196"},"modified":"2013-02-16T13:23:08","modified_gmt":"2013-02-16T17:23:08","slug":"confidentiality-in-mediation-how-broad","status":"publish","type":"post","link":"http:\/\/www.businessconflictmanagement.com\/blog\/2013\/02\/confidentiality-in-mediation-how-broad\/","title":{"rendered":"Confidentiality in Mediation: How Broad?"},"content":{"rendered":"<p>One doesn&#8217;t ordinarily look to California for exceptions to the broad scope of mediator confidentiality, but in <a href=\"http:\/\/scholar.google.com\/scholar_case?case=13776682492430052054&amp;q=mediation+confidentiality&amp;hl=en&amp;as_sdt=2,31&amp;as_ylo=2013\">Neighborhood Assistance Corporation v. First One Lending Corporation<\/a> (C.D. Cal. Jan. 29, 2013) we have one.<!--more--><\/p>\n<p>The claim alleged violations of the Lanham Act by the defendant corporation, which was alleged to have misrepresented its affiliation with plaintiff and damaged both plaintiff and its clients. \u00a0An issue arose as to the relationship of an individual defendant, Vescera, to the corporate defendant, with allegations of breach of the corporate form and use of corporate assets for personal purposes. \u00a0Vescera asserted that not he but another individual, Mariner, was the head of the corporation.<\/p>\n<p>In support of his defense, Vescera sought to introduce evidence that Mariner attended a mediation in the matter and introduced himself to those present as &#8220;Vice-President of Operations.&#8221; \u00a0Vescera argued that this statement was discoverable because it was not a &#8220;mediation communication.&#8221; \u00a0 Plaintiff objected on the ground that, by the plain reading of the relevant general order, &#8220;anything that happened or was said&#8221; at the mediation is confidential.<\/p>\n<p>Not so, said the court. \u00a0The full language of Section 9.1 of the <a href=\"http:\/\/court.cacd.uscourts.gov\/cacd\/GenOrders.nsf\/0\/74feb18abc785273882578ed007dfc78\/$FILE\/GO%2011-10.pdf\">General Order of the Court<\/a> controlling the question protects anything that is said &#8220;<em>relating to the subject matter of the case in mediation.<\/em>&#8221; \u00a0Introducing yourself does not relate to the subject matter of the mediation, held the court, and the statement is discoverable.<\/p>\n<p style=\"text-align: center;\"><img decoding=\"async\" src=\"https:\/\/encrypted-tbn3.gstatic.com\/images?q=tbn:ANd9GcQS23nHnfIUy4b6Bzq4VIf84krcGOkaHRDookz2pofbpaSbV-dPQw\" alt=\"\" \/><\/p>\n<p>(Mind you, if it didn&#8217;t relate to the subject matter of the mediation, why are the parties so adamantly arguing over it?)<\/p>\n<p>In any event, next time you ask for pasta when lunch orders are taken at the mediation, think about its ramifications&#8230;.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.thefablife.com\/files\/gallery\/rob_eats_on_talk_shows\/judge_judy_spaghetti.jpg\" alt=\"\" width=\"431\" height=\"323\" \/><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Warning: Saying hi in a mediation is not a protected communication<\/p>\n","protected":false},"author":3,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[14],"tags":[15],"class_list":["post-1196","post","type-post","status-publish","format-standard","hentry","category-mediation","tag-mediation"],"aioseo_notices":[],"_links":{"self":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/posts\/1196","targetHints":{"allow":["GET"]}}],"collection":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/users\/3"}],"replies":[{"embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/comments?post=1196"}],"version-history":[{"count":0,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/posts\/1196\/revisions"}],"wp:attachment":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/media?parent=1196"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/categories?post=1196"},{"taxonomy":"post_tag","embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/tags?post=1196"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
