{"id":1126,"date":"2012-10-03T10:45:16","date_gmt":"2012-10-03T14:45:16","guid":{"rendered":"http:\/\/businessconflictmanagement.com\/blog\/?p=1126"},"modified":"2012-10-03T10:45:16","modified_gmt":"2012-10-03T14:45:16","slug":"new-survey-on-international-arbitration-the-users-perspective","status":"publish","type":"post","link":"http:\/\/www.businessconflictmanagement.com\/blog\/2012\/10\/new-survey-on-international-arbitration-the-users-perspective\/","title":{"rendered":"New Survey on International Arbitration &#8212; The Users&#039; Perspective"},"content":{"rendered":"<p>GE Oil &amp; Gas attorney <a href=\"http:\/\/imimediation.org\/michael-mcilrath-biography\" target=\"_self\">Michael McIlwrath <\/a>has brought our attention to the recently released<em> 2012 International Arbitration Survey: Current and Preferred Practices in the Arbitral Process<\/em>.\u00a0 This study, conducted by the School of International Arbitration at Queen Mary, University of London, and the firm of White &amp; Case LLP, notes how international arbitration is actually practiced, and points to what practices might be preferred.<!--more--><\/p>\n<p>Some of the results of the survey are:<\/p>\n<ul>\n<li>The frequent practice of unilaterally-appointed &#8220;party&#8221; arbitrators&#8217; choosing a chair, after consultation with the appointing party, is generally\u00a0approved;<\/li>\n<li>Fast-track arbitration procedures, while broadly available, are infrequently used;<\/li>\n<li>Favorite methods of expediting arbitrations include early identification of issues to be determined and limitations on document exchange;<\/li>\n<li>Requests for interim relief are uncommon, and granted only 35% of the time;<\/li>\n<li>The <a href=\"http:\/\/law.queensu.ca\/international\/globalLawProgramsAtTheBISC\/courseOutlineMaterials2012\/internationalCommercialArbitration\/7IBARulesontheTakingofEvidence.PDF\" target=\"_self\">IBA Rules&#8217; <\/a>criteria (&#8220;relevant to the case and material to its outcome&#8221;) is the preferred standard for required document production, which is becoming more accepted as important to the outcome of cases;<\/li>\n<li>In most international arbitrations fact witness evidence continues to be offered by exchange of statements, with cross-examination (including preparation therefor) increasingly used;<\/li>\n<li>Civil lawyers conduct hearings that are shorter than common-law lawyers do;<\/li>\n<li>Sole arbitrators are expected to render an award within 3 months of hearing, and three-member tribunals within six months;<\/li>\n<li>Nearly all survey respondents thought it appropriate to take into account improper conduct by a party or counsel in awarding costs.<\/li>\n<\/ul>\n<p>The entire study can be found <a href=\"http:\/\/www.whitecase.com\/files\/Uploads\/Documents\/Arbitration\/Queen-Mary-University-London-International-Arbitration-Survey-2012.pdf\" target=\"_self\">here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A new study conducted by the Queen Mary School of International Arbitration and White &#038; Case LLP provides authoritative evidence as to what actually occurs in international arbitration.<\/p>\n","protected":false},"author":3,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9],"tags":[20],"class_list":["post-1126","post","type-post","status-publish","format-standard","hentry","category-arbitration","tag-arbitration"],"aioseo_notices":[],"_links":{"self":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/posts\/1126","targetHints":{"allow":["GET"]}}],"collection":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/users\/3"}],"replies":[{"embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/comments?post=1126"}],"version-history":[{"count":0,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/posts\/1126\/revisions"}],"wp:attachment":[{"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/media?parent=1126"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/categories?post=1126"},{"taxonomy":"post_tag","embeddable":true,"href":"http:\/\/www.businessconflictmanagement.com\/blog\/wp-json\/wp\/v2\/tags?post=1126"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
